Marketplace Terms
These terms cover the request-a-quote marketplace — the form where you describe a job and we pass it to nearby businesses so they can quote on it. They are for the person requesting the work. If you are a business using Kept to run your operations, the Terms of Service apply to you instead.
The one thing to understand: Kept introduces you to businesses. It is not the tradesperson. Any work you agree to is a contract between you and that business — they set the price, they do the work, and they are responsible for it. We are not a party to it and we do not take a cut of it.
1. Who this is with
The marketplace is operated by Lawn Envy Australia (ABN 19 863 392 800), trading as Kept.
2. What happens when you submit a request
- You tell us the type of work, your suburb and postcode, a description, and how to contact you.
- We match the request to businesses registered in that trade whose service area covers your address.
- Those businesses can see the request and choose whether to quote. We cap how many quotes a single request can receive so you are not buried in calls.
- Quotes come back to you, and you deal directly with whichever business you want to — or none of them.
3. What we share, and with whom
Your request — including your contact details — is shared with the businesses matched to it, so they can contact you about the job. That is the entire purpose of submitting it. We do not sell your information, we do not share it for anyone else's marketing, and we do not pass it to businesses outside the trade and area you asked for.
Businesses receiving your request are required, under their own agreement with us, to use your details only to quote on and carry out that job.
4. No guarantees
- We cannot guarantee you will receive any quotes, or a particular number of them. That depends on which businesses are active in your area.
- We do not set, review or negotiate prices.
- We do not verify the licensing, insurance, qualifications or quality of the businesses on the marketplace. Check licences and insurance yourself before engaging anyone, particularly for electrical, plumbing, gas or other licensed work.
- Disputes about the work, the price or the outcome are between you and the business. We will help put you back in touch where we reasonably can, but we cannot resolve them for you.
5. Your information and your choices
You can ask us to withdraw a request or delete your details at any time — email support@keptsoftware.com.au. Every alert we send also carries an unsubscribe link, and using it stops further marketplace contact from us.
Withdrawing a request stops us sending it to any further businesses. It cannot un-send it to businesses that already received it, and it does not oblige them to delete contact details they have already acted on — you would need to ask them directly.
6. Where your information is stored
Marketplace requests are stored in our primary database in Sydney, Australia. The full list of service providers involved in running the platform is on the Sub-processors page, and the Privacy Policy explains how to access or correct your information and how to complain.
7. How long we keep it
A request and its contact details are kept while it is live and for a reasonable period afterwards so businesses can follow up and so we can deal with any complaint about it. After that it is deleted. You can ask for deletion sooner at any time.
8. Fair use
Submit genuine requests for work you actually want done. Don't submit requests on someone else's behalf without their knowledge, don't use the form to advertise to businesses, and don't submit false or abusive content. We may decline or remove a request that breaches this.
9. Your rights under Australian law
Nothing here limits rights you have under the Australian Consumer Law or the Privacy Act 1988 (Cth). If we have not resolved a privacy concern to your satisfaction, you can contact the Office of the Australian Information Commissioner at oaic.gov.au.
