Terms of Service
These terms cover your use of Kept (app.keptsoftware.com.au) and this website (www.keptsoftware.com.au). By creating an account or using the app, you agree to them.
1. The service
Kept is quoting, scheduling, job-management, invoicing, payments and basic tax software for Australian service and trade businesses. It launches supporting lawn care, cleaning, pressure washing and handyman work in depth, with a further 24 trades selectable. It also includes an optional request-a-quote marketplace — separate terms apply to the people submitting those requests, at Marketplace Terms. The service is provided for your business's own operational use.
2. Plans and billing
- New accounts start on the Free plan — no card required, no time limit, capped at 15 clients and 15 jobs/quotes a month. You can use it for as long as you like within those limits.
- Paid plans (Solo, Crew, Team, Operation) are priced by how many people are using the account, and are billed monthly in advance from the day you upgrade, at the rate current when you did.
- Founding-member pricing, where you have it, holds the Solo rate you signed up at for 12 months from when it was applied, after which the account moves to the standard rate then current. It applies to the Solo plan only — Crew, Team and Operation are charged at their standard rates.
- We can change pricing going forward; existing customers will be given reasonable notice before a change takes effect on their account.
- An account with an unpaid or lapsed subscription may be suspended until it's resolved.
3. Refunds and cancellation
- On the Free plan: you are never charged — there is no card on file until you choose to upgrade.
- On a paid plan: you can cancel any time from Settings in the app, or by emailing us. Cancelling stops the next charge; your account stays usable until the end of the period you have already paid for.
- Part-months are not refunded as a matter of course, because you keep access for the rest of the period you paid for. Changing plan mid-cycle is prorated automatically.
- If we charge you in error — a duplicate charge, a charge after you cancelled, a charge at the wrong rate — tell us and we will refund it in full. We would rather fix that than argue about it.
- Your Australian Consumer Law rights are not affected. If the service has a major failure you are entitled to a refund or to cancel, and nothing in these terms limits that. This policy sits on top of those rights, not instead of them.
To cancel: Settings → Plan in the app, or email support@keptsoftware.com.au. Refunds go back to the card that was charged, usually within 5–10 business days once processed.
Payments taken by you from your own clients through Stripe Connect are between you and your client — your own refund policy governs those, not this one.
4. Your account and your password
This is the part worth reading carefully. Your business data is encrypted on your device with a key derived from your account password. We never store that password, and we have no way to decrypt your data without it. If you forget your password and don't have any device where the app is still logged in, your existing data cannot be recovered by us, or by anyone — this is a deliberate consequence of how the encryption works, not a limitation we can lift on request. Keeping your password somewhere safe is genuinely your responsibility, and losing it has real, permanent consequences.
You're responsible for keeping your login credentials confidential and for anything that happens under your account. Let us know promptly if you believe your account has been compromised.
5. Your data
You own the data you put into the app — your jobs, clients, quotes, invoices and everything else. We don't claim any ownership over it, and (per section 4) we can't read most of it even if we wanted to. You're responsible for the accuracy of what you enter, including anything that affects your own tax or GST obligations — the app's tax tools are a convenience, not professional tax advice, and you should check anything that matters with your own accountant.
6. Acceptable use
Use the app for genuine trade and service business operations. Don't use it to store or process anything unlawful, don't attempt to access another business's data or bypass the app's security, and don't use the service in a way that disrupts it for other users.
7. Suspension and termination
We can suspend an account for non-payment, suspected misuse, or a genuine security concern. You can stop using the service and close your account at any time; deleting an account permanently removes its data, including the encrypted content, and cannot be undone.
8. No warranty, limitation of liability
The app is provided without warranty of any kind, express or implied. We work to keep it reliable and your data intact, but we don't guarantee the service will be uninterrupted or error-free. To the extent permitted by Australian law, we're not liable for indirect or consequential loss arising from your use of the app, including loss of data that results from a forgotten password (see section 4) or from a failure to keep your own backups where that matters to you. Nothing in these terms excludes rights you have under the Australian Consumer Law that can't lawfully be excluded.
9. Changes to these terms
We may update these terms from time to time. Material changes will be reflected by an updated date at the top of this page, and continuing to use the app after a change means you accept the update.
10. Governing law
These terms are governed by the laws of Queensland, Australia.
